OFFICIAL RULES AND REGULATIONS
Key Dates
The Konek Waitlist Contest (the “Contest”) begins on September 30, 2026 at 12:00:01 a.m. Eastern Time (“ET”) and ends on November 20, 2026 at 11:59:59 p.m. ET (the “Contest Period”). Capitalized terms used in these Official Rules and Regulations (the “Rules”) have the meanings ascribed to them herein, and unless the context otherwise requires, words importing the singular include the plural and vice versa.
Eligibility
The Contest is open only to residents of Canada (excluding the province of Quebec) who have reached the legal age of majority in their province or territory of residence at the time of entry. Despite the foregoing, employees, representatives or agents (and those domiciled with any such employee, representative or agent) of Interac Corp. (the “Sponsor”), their parent, affiliated and related companies, the consulting, advertising and promotion agencies of the Sponsor and/or the independent contest organization(s) (including without limitation Proof Experiences (the “Administrator”) (collectively, the “Contest Parties”)), and any other person involved in the development or implementation of the Contest, are not eligible to enter, participate in, or win a Prize (as defined below) in the Contest. Despite the foregoing, employees of financial institutions that participate in or are affiliated with the Konek platform may participate in the Contest, provided they are not otherwise involved in the development, administration, or implementation of the Contest. The Contest is void where prohibited by law.
IMPORTANT NOTE RE: KONEK REGISTRATION – In order to be eligible to receive a Konek Entry (as defined below), each entrant must have or obtain an account with Konek (a “Konek Account”). To complete the Konek registration process and obtain a Konek Account, entrants must visit konek.ca/waitlist where you will be redirected to a secure page to link an eligible bank account to Konek. IMPORTANT NOTE: Not all financial institutions participate in Konek. Please visit konek.ca/waitlist under the FAQs section for a complete list of participating financial institutions that offer Konek.
Agreement To Be Legally Bound
By participating in this Contest, each entrant agrees to be bound by: (i) these Rules; (ii) the Website terms and conditions (available at: https://konek.ca/en/terms/) (the “Website Terms”); (iii) the Konek terms and conditions of use (available at: https://konek.ca/en/konek-terms-and-conditions-of-use/) (the “Konek Terms”); (iv) the Konek Privacy Policy (available at: https://konek.ca/en/privacy-policy/) (the “Konek Privacy Policy”); and (v) all decisions of the Sponsor, which are final in all respects.
How To Enter: Konek Entry
NO PURCHASE NECESSARY. There are two (2) ways to earn one (1) entry (an “Entry”) in the Contest: (i) a Konek Entry (as defined below); or (ii) a Mail-In Entry (as defined below). The Contest features five (5) Contest Waitlist Categories, each corresponding to a Waitlist Prize (as defined below): (a) The Subarctic Adventure Waitlist (Adventure), (b) the Rainforest Getaway Waitlist (Travel), (c) the Summer Playlist IRL Waitlist (music), (d) the Foodie Jet Dream Waitlist (Foodie/Dining), and (e) the Lowry Fan Experience Waitlist (Sports) (each, a “Contest Waitlist Category”). Entrants must select one (1) Contest Waitlist Category at the time of entry. IMPORTANT NOTE: You will only be entered for a chance to win one (1) of the five (5) available Waitlist Prizes. Make sure to review the Waitlist Prizes before you make your selection. Your selection will not impact your eligibility of winning a While You Wait Prize or receiving a WYW Offer (each as defined below).
KONEK ENTRY – ENTRANTS WITH AN EXISTING KONEK ACCOUNT: In accordance with Section 3 above, to receive one (1) Konek entry (a “Konek Entry”), entrants with an existing Konek Account must: (a) visit http://konek.ca/en/waitlist to obtain the official Contest entry form (the “Entry Form”) and fully complete the Entry Form with all required information (including your full name and the valid email address associated with your Konek Account*); (b) select the Contest Waitlist Category that you would like to be added to; and (c) signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules and the Konek Privacy Policy, and follow the on-screen instructions to submit your completed Entry Form. Once you have fully completed the foregoing steps, you will be eligible to earn one (1) Konek Entry. You may also opt in to receive marketing and promotional emails from the Sponsor and can opt out at any time. Opting in is not a condition of entry and will not impact your eligibility to participate.
KONEK ENTRY – ENTRANTS WITHOUT AN EXISTING KONEK ACCOUNT: To receive one (1) Konek Entry, entrants without an existing Konek Account must: (a) complete steps (a) through (c) set out in Section 5(i) above; and (b) follow the on-screen instructions to register for Konek (IMPORTANT NOTE: entrants will be redirected to a secure page to link an eligible bank account to Konek — see Section 3 above for further details). Once you have fully completed the foregoing steps, you will be eligible to earn one (1) Konek Entry.
*In order to receive a Konek Entry, each Entrant must complete the Entry Form using the same email address associated with their new or existing Konek Account.
HOW TO ENTER: MAIL-IN ENTRY
To earn one (1) entry in the Contest without obtaining a Konek Account, you must: (i) on a plain white piece of paper, print your first name, last name, telephone number, a valid email address, your selected Contest Waitlist Category, a minimum fifty (50)-word handwritten, unique and original essay on why they want the prize (ii) mail it (in an envelope with sufficient Canadian postage) to: Proof Experiences, C/O Konek Contest, 33 Bloor St. E, Suite 900, Toronto, ON M4W 3H1. Upon receipt of a valid mail-in request, you will be eligible to receive one (1) mail-in entry (a “Mail-In Entry”) in the Contest.
To be eligible to receive a Mail-In Entry, any mail-in request (a “Request”) submitted must be: (i) received separately in an envelope bearing sufficient Canadian postage (i.e. multiple Requests in the same envelope will be void); (ii) postmarked during the Contest Period and received by no later than November 27, 2026 (the “Request Deadline”); and (iii) completed and submitted in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion).
Limit of one (1) Mail-In Entry per unique and original Request per envelope with sufficient Canadian postage. Essays which are not unique and original or which do not reflect the essay theme above are void. The Released Parties (as defined below) are not responsible for any lost, stolen, misdirected, delayed, incomplete, illegible, damaged, late or destroyed Requests (all of which are void).
To be eligible, all content and materials associated with an Entry must: (i) be submitted and received in accordance with these Rules during the Contest Period, or by the Request Deadline, as applicable; (ii) include all required components and materials noted above; and (iii) otherwise be in accordance with these Rules (all as determined by the Sponsor in its sole and absolute discretion). Standard data rates apply to participants who choose to participate in the Contest via a mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation.
ENTRY LIMITS AND CONDITIONS
There is a limit of one (1) Entry per person during the Contest Period, regardless of whether the Entry is a Konek Entry or a Mail-In Entry. For greater certainty and the avoidance of any doubt, an entrant may not use multiple Konek Accounts or email addresses to participate in the Contest. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (a) exceed any of the limits stated in these Rules; (b) use multiple names, identities, Konek Accounts, email addresses, and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; (c) disrupt or participate in the Contest in any fraudulent or misleading way; and/or (d) participate in the Contest in any other manner that is disruptive, abusive, fraudulent, misleading, deceptive, unfair or inconsistent with the letter and spirit of these Rules; all as determined by the Sponsor in its sole and absolute discretion, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor (and, for greater certainty, if disqualified such person forfeits any and all rights to a Prize (which may be voided and/or revoked by the Sponsor in its sole and absolute discretion), and such person must return any Prize previously awarded to them immediately upon the Sponsor’s request, without limiting the Sponsor’s other rights and remedies both in law and in equity). The Contest Parties, and each of their respective agents, employees, directors, officers, successors and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries, Requests, Prize notification messages and/or any other Contest-related information (collectively, “Contest-Related Information”), nor any Contest-Related Information that has been sent in error or otherwise produced or disseminated in a manner that is inconsistent with these Rules, all of which are void.
An Entry may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry is not in compliance with these Rules.
BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF THE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE.
Verification
All Contest-Related Information and entrants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of compliance with these Rules (including, without limitation, proof of identity and/or eligibility) in a form acceptable to the Sponsor (including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Contest-Related Information submitted or received (or purportedly submitted or received) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of the Contest will be the official time-keeping device(s) used by the Sponsor. All information requested by and/or supplied to Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any entrant should the Sponsor deem that such an entrant at any stage supplied untruthful, incomplete, inaccurate or misleading information (all as determined by the Sponsor in its sole and absolute discretion).
Waitlist Prizes And Prize Conditions
There are five (5) Waitlist Prizes available to be won, one (1) for each Contest Waitlist Category. The following chart sets out the Contest Waitlist Categories, the corresponding Waitlist Prize and the approximate retail value (“ARV”) of each Waitlist Prize (each, a “Waitlist Prize”):

The Adventure Waitlist Prize ARV is $38,645 CAD (based on a hypothetical Toronto, Ontario departure point example – actual retail value may vary depending on departure point). To participate, the confirmed winner’s guest must have reached the age of majority in their province of residence. The Subarctic Adventure Waitlist Prize must take place October 16-22, 2027. |

The Foodie Waitlist Prize ARV is $32,155 CAD. The Foodie Jet Dream Waitlist Prize must take place from June 1 to July 30, 2027 IMPORTANT NOTE: The winner and guest are solely responsible for all costs and expenses associated with transportation to and from Toronto, Ontario. |

The Sports Waitlist Prize ARV is $17,400 CAD (based on the average retail value of one (1) jersey, court rental and two (2) basketball tickets and a photographer – actual retail value may vary). The Lowry Fan Experience Waitlist Prize must take place on the date specified by the Sponsor in its sole and absolute discretion. IMPORTANT NOTE: The winner and guest are solely responsible for all costs and expenses associated with transportation to and from Toronto, Ontario. |
The following prizes will be available during the Contest Period (each, a “While You Wait Prize” or “WYW Prize”). There is a limit of one (1) of each WYW Prize per entrant during the Contest Period.

The Waitlist Prizes and WYW Prizes are collectively referred to as the “Prizes”. Without limiting the foregoing, the following terms and conditions apply to each Prize: (i) each Prize must be accepted as awarded; (ii) each Prize is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (iii) no substitutions except at the Sponsor’s option; (iv) the Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or a component thereof with a prize of equal or greater retail value to the ARV of the specific Prize as stated in these Rules (as determined by the Sponsor in its sole and absolute discretion), including, without limitation, but at the Sponsor’s sole and absolute discretion, a cash award; (v) all characteristics and features of each Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (vi) gift cards are subject to the terms and conditions of the respective issuer; and (vii) the winner is solely responsible for all costs not expressly described herein.
Without limiting the foregoing (and for greater certainty, in addition to the terms and conditions under Section 16 above), the following terms and conditions apply to each Waitlist Prize: (i) each Waitlist Prize must be utilized on, or by, the dates specified by the Sponsor (otherwise the Waitlist Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (ii) the confirmed winner and their guest(s) must have all necessary documentation to permit travel and participation in the Waitlist Prize; (iii) the costs of everything not specifically and expressly stated above as included in each respective Waitlist Prize are the sole and absolute responsibility of the confirmed winner and their guest(s), including, without limitation, travel or medical insurance costs, transportation for the confirmed winner and their guest(s) to and from the applicable Canadian departure airport (unless otherwise included in the Waitlist Prize), excess baggage and other fees, and items of a personal nature (NOTE: the confirmed winner may be required to present a valid major credit card in their name at the time of hotel check-in to cover any incidental expenses); (iv) if the confirmed winner and their guest(s) do not utilize any part(s) of the Waitlist Prize for any reason, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (v) the Sponsor reserves the right at any time to: (A) place reasonable restrictions on the availability or use of the Waitlist Prize or any component thereof; and (B) substitute the Waitlist Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award (including, without limitation, if the fulfillment of the Waitlist Prize, or any part thereof, is rendered impossible, infeasible, unsafe or impractical for any reason, including, without limitation, due to any pandemic-related law, regulation, order, policy, guideline, strike, travel restriction, or for any other reason, all as determined by the Sponsor in its sole and absolute discretion); NOTE: without limiting the foregoing, in the event that any trip component of a Waitlist Prize is rendered impossible, infeasible, unsafe or impractical (as determined by the Sponsor, in its sole and absolute discretion), the applicable Waitlist Prize and/or any component thereof will be forfeited in its entirety and, if forfeited, the Sponsor is not obligated to offer any substitute prize component in its place; (vi) all arrangements relating to the Waitlist Prize must be made through the Sponsor or its designated agents; (vii) by accepting the Waitlist Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the Waitlist Prize or a component thereof does not prove satisfactory, either in whole or in part; (viii) any difference between the actual value of the Waitlist Prize and its stated ARV will not be awarded; (ix) all characteristics and features of the Waitlist Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (x) once booked, accommodations, travel (if applicable) and any other Waitlist Prize specifications cannot be changed; (xi) certain blackout dates and further restrictions may apply; and (xii) by participating in the Waitlist Prize, the winner and their guest(s) each: (A) signifies that they understand, acknowledge and accept that participation in the Waitlist Prize may involve danger and/or exposure to risks and hazards (including, without limitation, as may be due to the inherent risks of travel), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, they may suffer damage to personal property, serious personal injury, illness or even death; (B) signifies that they acknowledge and agree that the Released Parties have not made any warranties, guarantees or representations about their safety while participating in the Waitlist Prize; and (C) warrants and represents that they have evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agrees and assumes any and all such risks arising out of or connected with their participation in the Waitlist Prize.
While You Wait Offers
Throughout the Contest Period, all eligible entrants will be eligible to receive offers for complimentary food and beverage items (each, a “WYW Offer”). WYW Offers are not prizes and are not awarded by random draw. WYW Offers will be delivered to all eligible entrants (to their registered email accounts) on the applicable WYW Offer Drop Dates (as defined below). All entrants whose Entry has been received prior to the applicable WYW Offer Drop Date deadline will be eligible to receive the corresponding WYW Offer, subject to the redemption limits stated below. WYW Offers will decrease throughout the Contest Period as they are claimed. The following WYW Offers are available:
WYW Cookie Offer: Each WYW Cookie Offer consists of one (1) offer for one (1) free cookie from Andrea’s Cookies, located at 166 Ossington Ave, Toronto, Ontario. WYW Offer Drop Date: October 10, 2026. The offer must be redeemed in person during business hours on October 10, 2026. Available to the first three thousand three hundred (3,300) entrants who redeem in person, subject to availability. ARV: $4.50 CAD per cookie.
WYW Matcha Offer: Each WYW Matcha Offer consists of one (1) offer for one (1) free matcha from Forget Me Not Cafe, located at 506 Adelaide Street West, Toronto, Ontario. WYW Offer Drop Date: October 24, 2026. The offer must be redeemed in person on October 24, 2026. Available to the first approximately two thousand three hundred (2,300) entrants who redeem in person, subject to availability. ARV: $7.00 CAD per matcha.
WYW Burger Offer: Each WYW Burger Offer consists of one (1) offer for one (1) free burger from Rosie’s Burgers, located at 486 Front Street West, Toronto, Ontario. WYW Offer Drop Date: November 1, 2026. The offer must be redeemed in person on November 1, 2026. Available to the first approximately one thousand three hundred (1,300) entrants who redeem in person, subject to availability. ARV: $12.50 CAD per burger.
The following terms and conditions apply to each WYW Offer: (i) each WYW Offer must be redeemed in person on the applicable WYW Offer Drop Date stipulated above; (ii) each WYW Offer is subject to availability and will be distributed on a first-come, first-served basis up to the maximum number of redemptions stated above; (iii) each WYW Offer must be redeemed at the specific location listed above; (iv) in the event that a WYW Offer is no longer available at the time of attempted redemption, the entrant will not be entitled to any substitute offer, compensation or other remedy; (v) WYW Offer is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); and (vi) no substitutions except at the Sponsor’s option.
Eligible Winner Selection Process
Waitlist Prize Draw: On November 30th, at 10AM in Toronto, Ontario, the Administrator will perform five (5) random draws to select one (1) potential winner from among all eligible Entries in each Contest Waitlist Category received during the Contest Period. The odds of winning a Waitlist Prize depend on the number of eligible Entries in each Contest Waitlist Category received during the Contest Period.
WYW Prize Draws: On November 6, 2026, the Administrator will perform a random draw from among all eligible Konek Entries received on or before November 2, 2026 and all Mail-In Entries received on or before November 5, 2026, to select twenty (20) potential winners of the WYW Arc’teryx Gift Card Prize. On November 13, 2026, the Administrator will perform a random draw from among all eligible Konek Entries received on or before November 9, 2026 and all Mail-In Entries received on or before November 12, 2026, to select twenty (20) potential winners of the WYW Lululemon Gift Card Prize. The odds of winning a WYW Prize depend on the number of eligible Entries received prior to the applicable draw date.
For greater certainty, an entrant’s selection of a Contest Waitlist Category does not affect the entrant’s eligibility to win a WYW Prize or receive a WYW Offer.
Eligible Winner Notification Process
The Administrator will contact the potential winners of Waitlist Prizes and WYW Prizes on or around the applicable draw date, via email. Each potential winner is solely responsible for ensuring they are able to receive such notification messages, monitoring for such notification messages and following all instructions contained in such notification messages within the timelines provided, failing which, they may be disqualified (as determined by the Sponsor at its sole discretion) and will forfeit the applicable Prize.
Eligible Winner Confirmation Process
NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS THEM AS A WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING DECLARED A CONFIRMED WINNER OF A WAITLIST PRIZE OR A WYW PRIZE, each potential winner will be required, within five (5) business days of notification, to: (i) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (ii) sign and return the Sponsor’s declaration and release form, which (among other things): (a) confirms compliance with these Rules; (b) acknowledges acceptance of the Prize (as awarded); (c) releases the Released Parties from any and all liability in connection with this Contest, their participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; (d) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of their Contest-Related Information or any portion thereof; and (e) agrees to the publication, reproduction and/or other use of their name, city and province of residence, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in perpetuity throughout the world in any manner or medium whatsoever, including print, broadcast or the internet.
If, within five (5) business days of notification, as determined by the Sponsor in its sole and absolute discretion, a potential winner: (i) cannot be contacted as set out above, or if there is a return of a notification as undeliverable; (ii) fails to correctly answer the skill-testing question; (iii) fails to return the properly executed Contest documents (if applicable); (iv) cannot, or is unwilling to, accept a Prize (as awarded) for any reason; and/or (v) is determined to be in violation of these Rules; then he/she will be disqualified and will forfeit all rights to the applicable Prize and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner in accordance with the procedure outlined above, with the necessary amendments (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).
General Conditions
This Contest is subject to all applicable federal, provincial/territorial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest, including without limitation the eligibility of entrants or any Contest-Related Information, are final and binding on all entrants without right of appeal.
ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
The Sponsor is not responsible for any change of email address by entrants. All Contest-Related Information becomes the property of the Sponsor and, as applicable, no Contest-Related Information will be returned. The Released Parties will not be liable for: (i) lost Contest-Related Information or Entries or any failure of the Konek platform, the Contest website or any other website or platform during the Contest (including, without limitation, the failure to record Entries); (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment, programs, or software; (iii) the failure of any Contest-Related Information, winner notification message and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website or a combination thereof; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above. The Sponsor is not responsible if an entrant is unable to access the Konek platform or the Contest website on their mobile device, computer or other device. The Sponsor reserves the right at its sole and absolute discretion, to disqualify any individual (and all of their Prize claims and/or Entries) who tampers with the Konek platform or the Contest website.
The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend the Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of the Contest in any way (as determined by the Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to modify or suspend the Contest due to governmental or regulatory restrictions and/or guidance (including, without limitation, as such restrictions and/or guidance relates to health, safety, and/or contest requirements) and/or to comply with applicable law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend the Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever (including, without limitation, due to any Prize notification messages that have been sent in error or otherwise produced or disseminated in a manner that is inconsistent with these Rules, which for certainty are automatically void). The Sponsor reserves the right, in its sole and absolute discretion, to modify or suspend the Contest for any other cause beyond the reasonable control of the Sponsor that could corrupt, interrupt or interfere with the proper administration of the Contest. Without limiting the generality of the foregoing, the Sponsor reserves the right at any time, in its sole and absolute discretion, to administer an alternate or additional test of skill as it deems appropriate based on the circumstances, to address discrimination or disability issues and/or to comply with applicable law.
The Sponsor reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance of any entrants, Contest-Related Information and/or other information with these Rules, or as a result of any technical or other problems, to comply with applicable law or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of a dispute between entrants as to who submitted an Entry, such Entry shall be deemed to be submitted by the “authorized account holder” of the Konek Account or email address (as applicable) associated with the Entry. “Authorized email account holder” is defined as the natural person to whom an email address is assigned by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An entrant may be required to provide proof (in a form acceptable to the Sponsor) that they are the authorized account holder of the email address or Konek Account in question.
By participating in this Contest, to the maximum extent permitted by applicable law, each entrant agrees (and agrees to confirm in writing) and hereby: (i) releases the Released Parties from any and all liability, loss or damage that they may incur in connection with their participation in this Contest and, if applicable, with respect to the awarding, receipt, possession and/or use or misuse of a Prize and notifications in respect of Prizes (including, without limitation, Erroneous Notifications (as defined below)); (ii) agrees that, without limiting the generality of the foregoing and for greater certainty, under no circumstances will they be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, consequential, or any other damages; (iii) agrees that all causes of action arising out of or connected with this Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (iv) agrees that any and all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
If due to online, software, internet, computer or other error of any kind, more Prizes are printed, awarded or claimed than intended to be distributed or awarded according to these Rules (at any prizing level), then, in addition to having the right to terminate the Contest immediately, the Sponsor reserves the right in its sole and absolute discretion to invalidate and revoke all such erroneously printed, claimed or awarded Prizes. In no event will the Sponsor be liable to award more than the number of Prizes (at any prizing level) than as provided in these Rules and in accordance with these Rules. The Sponsor reserves the right to conduct a random drawing from amongst all eligible Prize claimants whose claims have not yet been redeemed to award the correct number of Prizes at the applicable prizing level (as stated in these Rules). If due to printing production, online, internet, computer or other error of any kind a Prize notification misstates the applicable Prize that an entrant is eligible to win (as determined by the Sponsor in its sole and absolute discretion on the basis of its official records) (an “Erroneous Notification”), despite the Erroneous Notification the applicable entrant will only be eligible to receive the applicable Prize that an entrant is eligible to win.
Personal information submitted to the Sponsor as part of an entrant’s participation in the Contest (including, without limitation, personal information submitted as part of completing a Konek Entry or Mail-In Entry, personal information associated with a Konek Account, and any personal information associated with any other Contest-Related Information) (collectively, “Personal Information”) will only be collected, used and disclosed by the Sponsor, the Administrator and their respective designated representatives and service providers for the purposes of administering the Contest in accordance with these Rules and otherwise as required to complete a transaction in accordance with the applicable terms (which may include, without limitation, the Konek Terms and the Website Terms).
By entering this Contest, each entrant expressly consents to the Sponsor, the Administrator and their designated representatives collecting, storing, sharing and using their Personal Information for such purposes and in accordance with the Konek Privacy Policy. This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their Personal Information. Without limiting the generality of the foregoing and for greater certainty, by entering the Contest, each entrant consents to being contacted (including by email) by the Sponsor and the Administrator for Contest-related purposes, which includes but is not limited to Prize eligibility notifications and Prize claim reminder notifications. By participating in this Contest, confirmed winners are deemed to have consented to the disclosure of their Personal Information to the Prize provider(s) for the limited purpose of delivery of Prizes.
Should it be discovered that an entrant is using the aid of computer software programs to auto-fill information, that entrant will be immediately disqualified from the Contest. The Sponsor reserves the right to disqualify all such entrants from future contests conducted by the Sponsor without further notice.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules, and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Contest website, Prize notification messages, and/or point of sale, television, print, radio, digital, online or any other type of advertising or other types of communications (including, without limitation, the abbreviated version of these Rules that appear on such advertising or other types of communications); the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law. Without limiting the generality of the foregoing, in the event the Sponsor becomes aware of any such discrepancy or inconsistency, the Sponsor will place a correction notice on the Contest website.
To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. To the fullest extent permitted by applicable law, the parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to the Contest.
The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
